Legal screening notes
Separate the landlord, PHA, program-compliance, and fair-housing routes
A written repair demand to the owner and an interim-inspection request to the public housing agency are separate steps. Keep proof of delivery for each recipient.
Under 24 C.F.R. § 982.405, a PHA must consider complaints and generally inspect within 24 hours for a reported life-threatening deficiency or within 15 days for another reported deficiency, unless HUD has approved a different period.
Under the current 24 C.F.R. § 982.404, after PHA notice an owner generally has no more than 24 hours to correct life-threatening defects and no more than 30 days for other defects. The current remedy provisions apply to HAP contracts executed or renewed on or after June 6, 2024; an older contract may remain under the prior rule until renewal.
Section 982.555 does not create an informal-hearing right for every inspection, unit-approval, owner-enforcement, or agency-inaction dispute. For those issues, request written reasons, records, supervisory review, and any complaint process in the current Administrative Plan instead of claiming a federal hearing entitlement.
Louisiana Civil Code article 2694 addresses necessary repairs after demand and a lessor's failure to act within a reasonable time. It does not create a blanket right to stop paying all rent as pressure. Deduction, withholding, termination, and moving can carry eviction or voucher risk and require fact-specific review.
A Low-Income Housing Tax Credit complaint should ask LHC to confirm program coverage and review compliance. Federal tax-credit monitoring rules authorize project and sample-unit inspections; they do not guarantee that the agency must inspect the complainant's particular unit on demand.
Fair-housing deadlines apply when facts involve a protected characteristic, disability accommodation, interference, or retaliation. An ordinary repair dispute is not automatically a federal fair-housing violation.
HUD currently permits HCV, PBV, and Mod Rehab programs to continue the pre-NSPIRE inspection protocol through January 31, 2027, with NSPIRE compliance due February 1, 2027. Ask which inspection standard the PHA is applying.

Demand repairs, request the right review, and preserve proof
This guide separates repair notice, voucher inspection, hearing eligibility, records, tax-credit compliance, and fair-housing screening. Personalized or fillable forms are available only through the paid prepared-form service. No request stops a deadline.
Send separate repair and inspection requests
Notify the landlord in writing and, if a voucher is involved, separately ask the PHA for an interim inspection. Identify life-threatening conditions and preserve delivery proof.
Route the review correctly
Use an informal-hearing request for a listed family decision. For an inspection result, owner remedy, unit approval, or agency inaction, request written reasons, supervisory review, records, and the complaint procedure in the current Administrative Plan.
Confirm program coverage
Before using a tax-credit or other program-compliance form, ask LHC or the administering agency to confirm that the property is covered by the program identified in the complaint.
Keep one condition-and-contact log
Record each condition, photo date, repair request, inspection, notice, person contacted, response, deadline, expense, health effect, move, and retaliation event.
Treat court, termination, and emergency notices as urgent
An intake or form does not pause an eviction, voucher termination, agency appeal, prescription, limitations, or court date. Seek individual help promptly.
Do not calculate a final deadline from this table. Use the linked primary law and obtain individual review.
Landlord repair demand
Article 2694 uses a reasonable-time standard after demand; it does not set one universal number of days.
A response date written by the tenant is a requested date, not automatically a statutory deadline. Do not assume the article authorizes withholding all rent.
PHA interim inspection after a condition complaint
Generally within 24 hours for a reported life-threatening deficiency and within 15 days for another reported deficiency, unless HUD has approved a different period.
Describe the condition precisely, ask how it was classified, and keep the complaint number. Inspection timing is different from the owner's later correction period.
Generally no more than 24 hours for a life-threatening defect and no more than 30 days for another defect under the current rule.
The current remedy provisions depend on the HAP-contract execution or renewal date. Ask for the written inspection report, notice date, cure date, and rule version being applied.
Informal hearing for an eligible PHA family decision
Use the deadline stated in the PHA notice and current Administrative Plan; § 982.555 does not supply one universal request period for every PHA.
First confirm that the decision is a hearing-eligible family determination. HQS findings, unit approval, and the PHA's choice of owner remedy are among the matters for which the federal rule does not require a hearing.
If a record is unavailable because it is in active use, R.S. 44:33(B)(1) requires prompt written certification and a date and hour within three days. If the custodian questions whether it is public, R.S. 44:32(D) requires a written determination and reasons within five days.
The triggers are different, Saturdays, Sundays, and legal public holidays are excluded, and neither rule guarantees complete production of every broad request within three days.
Generally not later than one year after the alleged discriminatory housing practice occurred or terminated.
Connect the facts to a protected characteristic, accommodation, interference, or retaliation. Submit promptly when the date is close and obtain individual review.
Generally not later than two years after the alleged discriminatory practice occurred or terminated; the statute excludes time during a qualifying administrative proceeding.
Accrual, tolling, conciliation, prior proceedings, forum, and other claims can change the calculation.
