Louisiana DWI discovery and evidence preservation
Create a custodian-by-custodian evidence map before recordings, data, samples, or private surveillance are overwritten or consumed.

The most valuable early work is often evidence control. Identify what should exist, who possesses it, the retention risk, what has been requested, what was produced, and what remains missing.
Criminal discovery is governed by Louisiana procedure and the case record. Article 716 addresses statements and recordings, while other provisions govern reports, tangible objects, tests, expert material, and continuing or reciprocal duties. A request should identify concrete categories and relevance.
A preservation request is not the same as a court order, and preservation does not establish discoverability or admissibility. It does, however, create a dated record identifying evidence and custodians before routine deletion or destructive testing.
Issue map
Government media
Identify every officer, vehicle, camera, station room, dispatch channel, call, CAD event, interview, booking area, jail, tow, and evidence system. Request native files and available metadata.
Chemical and laboratory material
Identify instrument records, raw data, method files, controls, maintenance, sample custody, consumption, remaining sample, audit history, analyst notes, and quality records.
Private evidence
Locate traffic, residential, business, vehicle, phone, health-device, and witness-held evidence. Preserve lawfully and document authenticity; do not access accounts or devices without authority.
Production ledger
Maintain an itemized request/response table with custodian, request date, delivery proof, response, format, hash, page or duration, gaps, and follow-up. Keep originals read-only.
Questions this route should answer
Is asking for everything sufficient?
Usually not. Specific categories, custodians, systems, dates, devices, relevance, and missing-item comparisons make the request more usable and enforceable.
Can missing evidence automatically dismiss the case?
No. The legal result depends on the evidence, apparent value, alternatives, preservation circumstances, state of mind, prejudice, and governing remedy.
Should downloaded evidence be edited?
Preserve an untouched original, record its source and hash, and work from copies. Editing or recompressing the only copy can destroy useful metadata and authentication evidence.
