Louisiana OMV hearing request after a DWI arrest
Build the written request, delivery proof, and administrative record without confusing the license case with the criminal case.
Source review: October 16, 2026R.S. 32:667 generally states that the written request must be made within 30 days from the arrest. Do not calculate from an arraignment or future court date.
What this pathway evaluates
When the statutory conditions apply, the officer seizes the license and issues a temporary receipt. That receipt ordinarily authorizes driving for no more than 30 days and serves as notice of the deadline to request an administrative hearing.
The statute contains a limited path for a later request—no later than 90 days from arrest—when incarceration, hospitalization, or another cause acceptable to the department prevented a timely request and supporting documentation is submitted. That is not a general extension.
A defensible workflow records the arrest date, notice date, request contents, delivery method, tracking, OMV receipt, hearing notice, and the exact suspension basis. It also preserves the agency record for any authorized court review.

Request and receipt
Use the current notice instructions. Preserve a signed copy, envelope or upload record, tracking history, delivery confirmation, and any OMV acknowledgment. A criminal motion does not substitute for the administrative request.
Hearing scope
R.S. 32:668 defines the administrative inquiry. Match the sworn report, arrest basis, advisement, test or refusal record, and department documents to the specific statutory issues.
Restricted driving
Eligibility, ignition-interlock requirements, insurance documentation, reinstatement conditions, and effective dates depend on the current record. Verify them with OMV rather than assuming that a hearing request creates unrestricted driving privileges.
Judicial review
An adverse administrative result may permit judicial review, but forum, filing period, service, record preparation, and the effect of filing must be confirmed from the final order and current statute.
Questions this route should answer
Is the 30-day period a suggestion?
No. Treat it as a hard statutory deadline unless the department accepts a documented later request under the narrow statutory provision.
Does requesting a hearing dismiss the DWI charge?
No. The hearing addresses the administrative license action, not guilt in the criminal prosecution.
Can I rely on a phone call to OMV?
A phone call may clarify procedure, but it is not a substitute for the written request and durable proof that the request was timely received.
