Traffic stops, detention, arrest, and DWI suppression
Reconstruct the seizure chronologically and identify the specific evidence, legal violation, and remedy actually at issue.
Source review: October 16, 2026What this pathway evaluates
A suppression theory is built event by event: what officers knew before the stop, what occurred during the detention, when the investigation expanded, when the arrest occurred, and how each challenged item was obtained.
Louisiana Code of Criminal Procedure article 703 permits a defendant adversely affected to seek suppression of unconstitutionally obtained evidence and to challenge confessions or statements on constitutional grounds. The motion must allege facts that would require relief; labels and conclusions are not enough.
The State may rely on observed violations, reliable tips, collective knowledge, developing impairment indicators, consent, warrants, or exceptions. The record should therefore include the complete video and dispatch chronology, not just selected report language.
Issue map
Basis for the stop
Identify the precise traffic violation, driving conduct, checkpoint plan, tip, BOLO, or other facts known before the seizure. Later observations cannot retroactively create the original basis.
Duration and expansion
Build a minute-by-minute timeline of records checks, questioning, field tests, backup arrival, canine or search activity, and arrest. Determine what facts allegedly justified each expansion.
Statements and searches
Separate roadside questions, custodial interrogation, consent, vehicle searches, inventories, warrants, blood draws, and phone access. Each can present a different legal test.
Remedy and causation
Even when conduct was unlawful, the remedy depends on the evidence obtained, the causal connection, standing, and any exception or attenuation argument. Identify the exact item sought to be excluded.
Questions this route should answer
Does a bad stop automatically dismiss the case?
No. A court analyzes the specific violation, challenged evidence, causal relationship, and available remedy. The State may also assert exceptions.
Can video contradict the written report?
Yes. Preserve and review the complete recording with timestamps. Apparent inconsistencies should be described accurately rather than overstated.
When must a suppression motion be filed?
Article 703 refers to the motion deadline in article 521, with limited exceptions and judicial discretion. Confirm the deadline from the docket and governing order immediately.
